By accessing or using the websites, mobile apps, reservation platforms, and ground transportation services provided by Gem Worldwide (“Gem,” “we,” “us,” or “our”) (collectively, the “Services”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the Services.
Gem provides chauffeured ground transportation, including airport transfers, corporate travel, group and event transportation, hourly service, special occasion transport, and VIP services across our affiliate network in 750+ cities worldwide. We may modify, suspend, or discontinue any part of the Services at any time.
Reservations are confirmed when you receive a confirmation number from Gem. Pricing is provided at the time of booking and is subject to applicable taxes, surcharges, gratuities, and tolls.
Cancellation windows and fees vary by service type. The cancellation terms applicable to your booking are provided at the time of reservation and in your confirmation. Late cancellations and no-shows may incur fees up to the full trip amount.
You authorize Gem to charge the payment method on file for the trip total, including applicable taxes, gratuities, fees, and any post-trip charges (e.g. tolls, wait time, additional stops, cleaning). Disputed charges should be raised with Gem within 30 days of the trip date.
You agree to use the Services lawfully and respectfully. You will not (a) misuse or interfere with the Services; (b) attempt to access accounts or data not your own; (c) damage Gem property; or (d) engage in unlawful conduct during a trip. Gem may refuse or terminate service for safety, legal, or policy reasons.
To the maximum extent permitted by law, Gem and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data, arising from your use of the Services. Gem’s aggregate liability for any claim arising out of or relating to the Services is limited to the amount you paid Gem for the trip giving rise to the claim.
You agree to indemnify and hold harmless Gem, its affiliates, and their officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or your breach of these Terms.
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any disputes arising out of or relating to these Terms or the Services shall be resolved in the state or federal courts located in Middlesex County, New Jersey, unless required otherwise by applicable consumer protection law.
We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when the Terms were most recently revised. Continued use of the Services after a change constitutes acceptance of the updated Terms.
